Mix 107.9’s Sold Short By Santa Sweepstakes – Official Contest Rules

METHOD OF ENTRY: Beginning Monday, 1/08/2024 through Friday, 1/12/2024 (“Promotional Period”), central Ohio Mix 107.9 (WVMX) listeners 18 and over will have three (3) opportunities each weekday (Monday-Friday), to enter a keyword at MyMix1079.com for a chance win a restaurant gift card and be qualified for a chance to win a Meta Quest 3 New Mixed Reality VR Headset.

Each weekday throughout the promotional period, a new keyword will be announced by Mix 107.9 personalities at approximately 9:00am, 1:00pm, and 4:00pm. Listeners may go to MyMix1079.com to enter each keyword to register each time there is a new keyword announced for a total of 15 possible entries. Listeners will have one (1) hour to enter each keyword. Listeners must also provide their full name, address, date of birth, phone number, and postal code to complete the registration and be officially entered into the contest.

Any attempt by any participant to obtain more than the stated number of entries allowed by using the same, multiple/different email addresses, identities, or any other methods voids that participant’s entries, and that participant may be disqualified. No mechanically reproduced or automated entries are permitted. Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void. Any entry on behalf of another individual or using another’s name or email address is disqualified and ineligible to win any prize. The winner will be chosen at the sole discretion of Mix 107.9. No purchase necessary.

PRIZE SELECTION: One (1) winner will be selected randomly for each day of the promotional period from among all qualified entries by a Mix 107.9 representative at approximately 5:00pm and contacted by a representative of Mix 107.9 to confirm their prize on the same day. There will be a total of five (5) qualifying winners. Once a winner has been chosen as a qualifier, they are no longer eligible to win qualifying prizes. The qualifying prizes will be awarded as follows:

  • Monday, 1/8/2024: One (1) Skyline Chili gift card worth $50.00
  • Tuesday, 1/9/2024: One (1) Wendy’s gift card worth $50.00
  • Wednesday, 1/10/2024: One (1) Bob Evans gift card worth $50.00
  • Thursday, 1/11/2024: One (1) Roosters gift card worth $50.00
  • Friday, 1/12/2024: One (1) Crimson Coffee gift card worth $50.00

On Monday, 1/15/2024, at approximately 9:15am, one (1) Grand Prize winner will be selected from among all qualifying prize winners and announced on-air. The Grand Prize winner will receive a Meta Quest 3 New Mixed Reality VR Headset. The total approximate retail value for the Grand Prize, including the qualifying Prize is $550.00. The Grand Prize winner will be contacted to confirm their Prize the same day the announcement is made on-air, Monday, 1/15/2024. If a chosen entrant is notified by email, voicemail, or other answering device, he or she will have 24 hours from the time we contact them to respond. If the chosen online entrant does not contact us back within the time limit, he or she will be disqualified, and another winner will be chosen from all eligible entrants. This process will continue until a winner is identified.  Each winner’s full name and city of residence will be posted at MyMix1079.com and may be shared across Mix 107.9 social media accounts.

Mix 107.9 will make reasonable efforts to award Prizes 30 days after winning. The station’s sole responsibility will be to award Prizes and will have no further responsibility in connection with Prizes if the Prize winner, for any reason, cannot or decides not to use the Prize. Winners will be responsible for any applicable federal and state taxes as well as all fees associated with their Prize. The winner must have a valid state ID and complete an IRS Form W-9 to collect their Prize. Prizes are not transferrable or redeemable for cash. By entering this contest, participants understand the nature of the prize they are competing to win. In the event that the prize winner declines acceptance of any of the prizes, an alternate eligible winner will be randomly chosen.

ELIGIBILITY: Mix 107.9 shall have no responsibility for contestant’s inability or failure to participate, failure to win or claim any prize based on malfunction or difficulties with telephone, cell phone, texting, email, or internet access, or any other circumstances in any contest beyond Mix 107.9’s control.

Mix 107.9 contests are open to all eligible Columbus, OH residents 18 or older that have not won anything on Mix 107.9 in the past 30 days or any prize valued at $600 or more in the past 6 months. Only one winner per household is permitted within 30 days after a household has a winner. Any prize awarded to an ineligible listener will be deemed null and void, and an alternate eligible winner may be named.

Employees of Mix 107.9, Columbus Radio Group, Franklin Communications, Inc, and its ultimate parent company, Saga Communications, Inc., their advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one-hundred-mile radius of the Mix 107.9 main studio are not eligible to win any contest. Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. This also includes individuals for whom the employee is the current legal guardian.

General Contest Rules

These are the rules governing all contests aired on Mix 107.9 radio and on the mymix1079.com website or Mix 107.9 mobile app, unless otherwise specified. In the following rules, “Mix 107.9” means Franklin Communications, Inc., dba CBUS Media Group and its parent corporation, Saga Communications, Inc., which owns Mix 107.9 radio:

  1. No purchase is necessary to enter any Mix 107.9 contest.
  2. To be eligible to win any prize on Mix 107.9 you must not have won anything on Mix 107.9 in the past 30 days or any prize valued at 600 or more in the past 6 months. Only one winner per household is permitted within 30 days after a household has a winner. Any prize awarded to an ineligible listener will be deemed null and void, and an alternate eligible winner may be named.
  3. Anytime you call the Mix 107.9 studios you assume that your call will be broadcast or recorded and you grant us permission to broadcast the call or record it for later broadcast.
  4. As a winner of a Mix 107.9 contest your voice, name and/or picture may be used for promotional, broadcast, or internet purposes without any compensation to you.
  5. Prizes awarded are not redeemable for cash. No prize is transferable. No substitution for a prize will be made at the request of winner. Mix 107.9 reserves the right to substitute a prize of similar value.
  6. All winners of all contests are responsible for all taxes on prize awarded. All winners of a prize valued at $600 or more awarded on or before 12/31/2025 or of a prize valued at $2,000 or more awarded on or after 1/1/2026 will be required to complete the appropriate tax forms at the Mix 107.9 studios prior to claiming prize. All winners will be sent a 1099 MISC federal tax form if in one calendar year the prize value of all prizes won exceeds the previous specified value.
  7. In the event the winner is subject to or the subject of any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgment, lien, and the like), Mix 107.9’s delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as (Mix 107.9) awarding the prize to the winner. Mix 107.9 shall be entitled to rely in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. Mix 107.9 shall not be liable for any claim by any winner for damages incidental thereto.
  8. All Mix 107.9 contests are open to all eligible residents 18 or over (unless otherwise specified) living within 75 miles of station transmitter(s). Contestants must possess a valid form of identification bearing the picture of the contestant acceptable to Mix 107.9 that will be presented to Mix 107.9 and accepted before the prize is awarded. Employees of Mix 107.9, it's advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one hundred mile radius of the Mix 107.9 main studio are not eligible to win any contest. Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and their spouse. This also includes individuals for whom the employee is current legal guardian.
  9. Winners will be expected to claim prize at the Mix 107.9 studios, 4401 Carriage Hill Lane, Columbus, Ohio 43220, between 12:00pm – 5:00pm, Monday through Friday (excluding holidays) within 30 days of being notified that they are winners, unless there is an expiration date on prize, which will be specifically stated.
  10. Where the prize(s) consists of paper tickets (“will-call tickets”) the winner will be directed to go to a specified address and retrieve the will-call tickets, and, by entering the contest, the contestant agrees to pick up will-call tickets and sign and deliver to Mix 107.9 a waiver form as directed. Where the prize(s) consists of electronic (digital) concert or event tickets (“e-tickets”), the winner will receive an email from Mix 107.9 with a hyperlink to an electronic waiver form that the winner must sign and return to the Mix 107.9 before the prize will be transferred to the winner. The e-tickets will be transferred to the winner by Mix 107.9 or, in some cases, by a third party (for example, Ticketmaster, Live Nation, etc.) and the winner must check his or her email account for an email or cellular mobile number for a text message from the ticket provider in order to download the e-tickets. Where e-tickets are a prize, as a condition of entering the contest, redeeming and using e-tickets requires the winner (i) to have a valid email address and an app-enabled mobile device capable of downloading and running a third-party mobile ticketing app (e.g., Ticketmaster, Live Nation, etc.); (ii) to install, or have already installed, such mobile ticketing app on their app-enabled mobile device; and (iii) to log into an existing user account or sign up for a free user account with the third-party operating such mobile ticketing app by completing a form with all required information, including, at a minimum, the winner's first name, last name, valid email address and telephone number. E-tickets awarded as a prize in such contests cannot be redeemed or used by any means other than the designated third-party mobile ticketing app for the e-tickets. Individuals who do not have a valid email address, access to an app-enabled mobile device and/or do not comply with these requirements will not be able to redeem or use e-tickets should they be selected and verified as a winner, will not receive a substitute prize, and should not enter contests where e-tickets are the prize.
  11. Mix 107.9 reserves the right to disqualify any entrant if any contest rules are violated in any way.
  12. Mix 107.9 assumes no liability for situations, repairs, or incidents arising from any aspect of any prize awarded in any contest. Mix 107.9, its advertising agencies, affiliates, contest sponsors, employees, and immediate families of each are absolved and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest.
  13. As a licensee of the FCC and a trustee of the public airwaves, Mix 107.9 reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of Mix 107.9 management if world events, the national mood, or public safety so warrant.
  14. Mix 107.9 reserves the right to amend the rules to any contest at any time. Mix 107.9's decision is always final. In the event any one of the general contest rules which govern all Mix 107.9 contests contradict with any specific contest term, the specific contest term will control.
  15. For any contest requiring phone entry you must use only the following number unless otherwise specified: 614-542-1079. . The person processing inbound calls and/or texts at Mix 107.9 has the final decision as to who is the winning entrant.
  16. Mix 107.9 shall have no responsibility for contestant’s inability or failure to participate, failure to win or claim any prize based on malfunction or difficulties with telephone, cell phone, texting, email, mobile applications, internet access, or any other circumstances in any contest beyond Mix 107.9’s control.
  17. For any contest involving on-line voting: If an entrant receives irregular votes, including but not limited to, votes generated by a robotic, programmed, script, macro, or other automated means, Mix 107.9 reserves the right to disqualify the entrant in its sole discretion and/or use another means to determine the winner(s), ex. – random selection or appointing a panel of judges.
  18. For any contests involving tickets to live performances or events, winners will need to follow all health and public safety guidelines and protocols put in place by the concert organizer.
  19. Mix 107.9 is not responsible for any event cancellations or reschedules.
  20. Mix 107.9 is not responsible for:
    • internet crashes or slowdowns caused by network congestion
    • viruses
    • sabotage
    • satellite failures
    • phone line failures
    • electrical outages
    • natural or man-made disasters
    • lost, late, misdirected, postage-due, unintelligible, returned, or undelivered entries or email
    • lost, interrupted, or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other internet connections, providers, or platforms
    • failed telephone, satellite or cable hardware or software or lines, or jumbled, scrambled, delayed, or misdirected transmissions
    • computer hardware or software malfunctions, failures, or difficulties
    • other errors of any kind whether human, mechanical, electronic, or network

    Persons who tamper with or abuse any aspect of this contest or website, or act in violation of the official service, as solely determined by the station, will be disqualified. Neither sponsor nor promotion parties are responsible for any incorrect or inaccurate information whether caused by website users, tampering, hacking, or by any of the programming or equipment associated with or used in this contest, and assume no responsibility for any errors, omissions, deletions, interruptions or delays in operation or transmission or communication line failure, theft or destruction or unauthorized website access.

    Mix 107.9 is not responsible for injury or damage to participant’s or any other person’s computer or property related to or resulting from participating in this contest. Should any portion of contest be, in Mix 107.9’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention (i.e., hackers) or other causes which, in the sole opinion of the station, corrupt or impair administration, security, fairness or proper play of this contest, or contest plays, Mix 107.9 reserves the right at its sole discretion to suspend, modify or terminate the contest.

  21. Mix 107.9 has not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on prize (if any) are provided only by the manufacturer, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee.
  22. The following are specifically related to E-contests and E-Mail Club promotions on mymix1079.com:
    1. All appropriate information in required fields must be entered correctly and completely or you will be disqualified.
    2. To win a prize you must reside within the listening area of Mix 107.9 as defined at the exclusive discretion of Mix 107.9 management.
    3. Any problems with the internet or email are not Mix 107.9’s responsibility.
    4. Contestants who register to participate on our website may be required to produce a printed copy of proof of registration before being allowed to participate in the contest.
    5. Due to the nature of our programs that are heard on-line over the internet, contests may not be heard at all on Mix 107.9. Contests heard on the radio station’s internet audio stream may be slightly delayed from the time the contests are heard on the broadcast station, and will be running behind the broadcast signal. Thus, all contests heard on the internet are delayed. This delay can last for as much as 30 seconds or more. This means that when Mix 107.9 contests are played that require a specific caller to telephone the radio station (such as “Caller number 9 when you hear the sound effect”), listeners to the on-line audio stream may be at a disadvantage in participating over those listeners who hear the contests on-air.
